The highest court has temporarily stopped Rahul Gandhi from being convicted in the defamation case related to his comments about the surname “Modi. ”
The decision will bring back his position as a member of the Lok Sabha representing Wayanad constituency in Kerala. The order was given by a group of three judges led by Justice BR Gavai.
The highest court said that the lower court did not explain why it gave the Congress leader the harshest punishment of two years.
Gandhi was unable to run for office because of a rule that said politicians couldn’t serve longer than two years. This not only affected him, but also the people who were supposed to vote for him in his area.
The judges mentioned that Gandhi should have been more cautious while making the statements that caused the defamation case against him.
The Supreme Court said that Rahul Gandhi’s statements were not appropriate. They believed that someone in a position of public influence should have been more cautious when speaking in public.
The top court said that even though the lower court and High Court have written a lot of pages refusing to delay the punishment, they have not thoroughly investigated these aspects.
